Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Lumeni: Photo Editor ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of the App, including users who access the App via the Apple App Store.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes strictly in accordance with these Terms and Apple's App Store Terms of Service.

You may not:

• Copy, modify, or distribute the App or any part of it
• Reverse-engineer, decompile, or disassemble the App
• Use the App to develop a competing product or service
• Remove or alter any proprietary notices or labels on the App

3. In-App Purchases & Subscriptions

The App may offer premium features through one-time purchases or auto-renewable subscriptions ("Premium").

• Billing: Payment is charged to your Apple ID account at confirmation of purchase.
• Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Cancellation: You can cancel anytime via Settings → Apple ID → Subscriptions.
• Refunds: All purchases are subject to Apple's refund policy. We do not process refunds directly — please contact Apple Support.
• Price changes: We reserve the right to change subscription prices. You will be notified of any price changes before they take effect.

Free trials, if offered, will automatically convert to a paid subscription unless cancelled before the trial period ends.

4. Acceptable Use

You agree to use the App only for lawful purposes. You must not use the App to:

• Edit, create, or distribute images that are defamatory, obscene, or otherwise unlawful
• Infringe on the intellectual property, privacy, or publicity rights of any person
• Edit photos of individuals without their consent in a manner that could harm or mislead
• Circumvent or attempt to circumvent any technical restrictions in the App

5. Intellectual Property

All content, design, graphics, code, and technology within the App are owned by us or our licensors and are protected by applicable intellectual property laws.

Your photos remain your property at all times. We claim no ownership over any images you edit using the App.

6. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Fitness for a particular purpose
• Accuracy or reliability of AI-generated results
• Uninterrupted or error-free operation

AI-powered features (such as relighting, depth estimation, and portrait retouching) produce results based on machine learning models and may not always be perfect. Results may vary depending on photo content, lighting conditions, and device hardware.

7. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the App, including but not limited to loss of data or image quality.

Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

8. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you agree to the terms of our Privacy Policy, which is incorporated into these Terms by reference.

9. Third-Party Frameworks

The App uses third-party technologies (CoreML, Vision, OpenCV) solely for on-device processing. Your use of the App is subject to any applicable terms of those third-party providers, though we do not share your data with them beyond what is processed locally on your device.

10. Apple-Specific Terms

You acknowledge that:

• These Terms are between you and us, not with Apple.
• Apple has no obligation to provide any maintenance or support for the App.
• Apple is not responsible for addressing any claims relating to the App.
• In the event of any third-party claim that the App infringes intellectual property rights, Apple is not responsible for the investigation or settlement of such claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them.

11. Changes to These Terms

We reserve the right to update these Terms at any time. When we do, we will update the "Last Updated" date at the top of this document. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.
